Terms of Use for Flevario

Welcome to Flevario! These Terms of Use ("Terms") constitute a legally binding agreement between you ("User" or "you") and TIIN S.R.L. ("Flevario", "we", "us"), regarding your use of the Flevario mobile application and related services.

By creating an account or subscribing to a Flevario plan, you agree to these Terms. If you do not agree, you may not use our services.

1. What is Flevario?

Flevario is a digital membership platform that connects coffee lovers with partner cafés. We provide a subscription-based service that allows you to access exclusive discounts on specialty coffee at participating locations.

Important Notice: Flevario is a technology provider, not a café. The actual coffee and products are provided by independent third-party merchants ("Partner Cafés"). We are not responsible for the quality, safety, or availability of the products served by Partner Cafés.

2. Your Account & Security

  • Eligibility: You must be at least 18 years old to use Flevario.
  • One Device Policy: To prevent fraud, your Flevario account is linked to a specific mobile device ("Device Binding"). You may not share your account login with others. Simultaneous logins on multiple devices are prohibited.
  • Account Security: You are responsible for keeping your credentials confidential. If you suspect unauthorized access, contact us immediately at support@flevario.com.

3. Subscriptions & Payments

Plans: We offer various tiers (e.g., "Launch Pass", "Explorer"). Specific benefits (discount percentages, daily caps) are described in the app at checkout.

Billing: Payments are processed securely via third-party providers (Stripe, Apple App Store, or Google Play Store). Subscriptions renew automatically unless canceled at least 24 hours before the end of the current period.

Cancellation: You may cancel your subscription at any time via the App Settings or your App Store subscription management page. You will retain access to benefits until the end of the current billing cycle.

Right of Withdrawal: By purchasing a digital subscription and immediately accessing benefits (discounts), you acknowledge that you lose your right of withdrawal once the service performance has begun, in accordance with Romanian consumer law (OUG 34/2014, Art. 16).

4. Using Discounts (Redemption Rules)

To ensure fair use for our Partner Cafés, the following rules apply:

  1. Rotating QR Codes: Discounts are redeemed via a dynamic QR code generated in the app. This code refreshes every 60 seconds. Screenshots of QR codes will not work and may be flagged as fraud.
  2. In-Person Redemption: You must be physically present at the café and present your phone to the barista to redeem a discount.
  3. Fair Usage Limits: Plans may have daily or monthly caps (e.g., "Max 2 drinks discounted per day"). Once a cap is reached, standard prices apply until the limit resets.
  4. Anti-Abuse: We monitor for irregular patterns (e.g., "replay attacks" or location spoofing). We reserve the right to suspend accounts suspected of technically manipulating the app to bypass limits.

5. Limitation of Liability

To the maximum extent permitted by applicable law, TIIN S.R.L. shall not be liable for:

  • Any indirect, incidental, or consequential damages arising from your use of the app.
  • Service interruptions due to maintenance, internet failure, or third-party provider downtime (e.g., AWS, Stripe).
  • The quality or availability of coffee/food at Partner Cafés. Any dispute regarding a product must be resolved directly with the café.

6. Termination

We reserve the right to suspend or terminate your account immediately, without notice, if you violate these Terms, specifically regarding:

  • Fraudulent redemption attempts.
  • Sharing accounts or selling access to third parties.
  • Harassment of café staff or Flevario support personnel.

7. Governing Law & Consumer Rights

These Terms are governed by the laws of Romania. Any disputes will be subject to the exclusive jurisdiction of the courts in Bucharest.
